These Terms & Conditions ("Terms") govern your use of the Birdies Golf website, reservations, memberships, gift cards, and related services provided by Birdies Golf LLC ("Birdies Golf," "we," "us," or "our").

By accessing our Website, making a reservation, purchasing a membership or e-gift card, or otherwise using our Website or services, you agree to these Terms.

If you do not agree to these Terms, please do not use our Website or services.

1. Website Use

The Birdies Golf Website is provided for informational, booking, purchasing, and customer-service purposes.

You agree to use the Website lawfully and not to:

• Violate applicable laws or regulations

• Attempt to gain unauthorized access to the Website or its systems

• Interfere with the operation or security of the Website

• Submit false or misleading information

• Use the Website for fraudulent or unlawful purposes

• Attempt to interfere with another customer's account or reservation

Birdies Golf reserves the right to restrict or terminate access to the Website when reasonably necessary.

2. Reservations

Reservations may be available for Birdies Golf's golf simulators, putting course, and other services.

Availability, pricing, reservation durations, and other booking terms are displayed during the booking process and may change from time to time.

A reservation is considered confirmed once the applicable booking process has been completed and, where required, payment has been successfully processed.

Customers are responsible for providing accurate contact and reservation information.

3. Golf Simulator Reservations

Golf simulator reservations are subject to the availability and pricing displayed at the time of booking.

Customers are responsible for making reservations for the correct date, time, and duration.

Any applicable participation waiver or other required agreement must be completed before participating in activities at Birdies Golf.

4. Putting Course Reservations

Putting course reservations are subject to availability and the pricing displayed at the time of booking.

Any applicable participation waiver or other required agreement must be completed before participating in activities at Birdies Golf.

5. Cancellation and Changes

Birdies Golf enforces a strict 12-hour cancellation policy.

Anytime 12 hours or more before your scheduled tee time, you may cancel or modify your reservation without a cancellation fee by calling Birdies Golf at 201-627-3368.

If you:

• Cancel less than 12 hours before your scheduled tee time;

• Reduce the number of hours booked for your reservation less than 12 hours before the scheduled tee time; or

• Fail to attend your reservation,

you will not receive a refund for the canceled, reduced, or missed portion of the reservation.

6. Late Arrivals and No-Shows

Customers are expected to arrive on time for their reservations.

If you are more than 20 minutes late for your reservation without contacting Birdies Golf, your reservation may be considered a no-show.

No-shows will not receive a refund.

Late arrival does not automatically extend the reservation. Your reserved time remains subject to the original scheduled end time unless Birdies Golf determines otherwise.

7. Pricing and Payments

Prices displayed on the Website are subject to change.

Applicable taxes, fees, and other charges will be displayed during the booking or purchasing process when applicable.

Payments made through the Website may be processed by Stripe or another authorized payment processor.

By submitting payment information, you represent that you are authorized to use the payment method provided.

Birdies Golf reserves the right to correct pricing errors and to cancel or modify an order or reservation affected by an obvious pricing or technical error.

8. Golf Simulator Memberships

Birdies Golf simulator memberships include one hour of individual play per day.

Multiple members or guests may play together during a member's reserved hour; however, each non-member guest will be charged $20 per hour.

Membership usage is limited to one hour per day.

Membership pricing is based on the current pricing applicable from May through October. Membership rates may increase during the winter months of November through April.

A Birdies Golf account is required to purchase and use a golf simulator membership.

Memberships are intended for individual use only and are not transferable.

Birdies Golf reserves the right to suspend or terminate a membership at its discretion without prior notice where permitted by law.

By purchasing or using a Birdies Golf membership, you agree to these membership terms.

9. E-Gift Cards

Birdies Golf e-gift cards are valid for golf simulator services only.

Birdies Golf e-gift cards do not expire.

Gift cards are not transferable.

Gift cards may not be redeemed for cash except where required by applicable law.

Birdies Golf is not responsible for lost, stolen, or improperly used gift cards to the extent permitted by law.

10. Facility and Service Availability

Birdies Golf may temporarily modify, suspend, or discontinue portions of its services, Website, booking availability, or operating schedule when reasonably necessary.

This may include circumstances such as maintenance, equipment issues, technical problems, emergencies, facility closures, or other circumstances affecting operations.

Birdies Golf will make reasonable efforts to provide notice when practical.

11. Third-Party Services

The Website may rely on third-party services for booking, payment processing, analytics, advertising, email marketing, and other functionality.

Third-party services may have their own terms and privacy policies. Birdies Golf is not responsible for the independent acts, policies, or practices of third-party providers.

12. Intellectual Property

The Birdies Golf Website and its content, including logos, branding, text, graphics, photographs, videos, designs, and other materials, are owned by or licensed to Birdies Golf and are protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, publish, sell, or otherwise use Birdies Golf's content without prior written permission, except as permitted by law.

To the extent permitted by law, the Website and its content are provided on an "as is" and "as available" basis.

Birdies Golf does not guarantee that the Website will always be available, uninterrupted, error-free, or completely secure.

To the maximum extent permitted by applicable law, Birdies Golf LLC will not be liable for indirect, incidental, consequential, special, or punitive damages arising from your use of the Website or online booking services.

Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

These Terms, together with any additional terms presented to you at the time of a particular purchase, reservation, membership, or service, constitute the agreement between you and Birdies Golf regarding your use of the Website and services.

Separate waivers or agreements required for participation in activities at Birdies Golf are governed by those agreements.
